This agreement, which constitutes the Astrologer's Terms and Conditions, is a legal agreement (“Agreement“) between Astrologer (“You“) and AstroDhyaan in connection with access and or use of the platform for providing on-line advice/services at all websites powered by AstroDhyaan, or owned by Ojas Softech Private Limited. The Sites are currently owned and operated by Ojas Softech Private Limited (“AstroDhyaan“).
This Agreement sets forth and contains the terms and conditions between you i.e. the Astrologer and AstroDhyaan.
By using any portion of the website or app you agree to be bound by this Agreement. It is advisable that you should read this Agreement carefully. In the event, if you do not agree to be bound by any clause of this agreement, you should immediately cease from using any portion of the website.
AstroDhyaan solely reserves the right to modify this Agreement any time to comply with law or provision of service or for any other reason solely at the discretion of AstroDhyaan, which may or may not be separately notified via email. You can determine when these Terms were last revised by referring to “Last Amended“ at the top of these Terms.
You are an “Astrologer“ if you are selected or appointed or registered as Astrologer with the explicit purpose of providing your consultation to the visitors/users of the AstroDhyaan Platform and or on partner Sites. Your Astrologer Registration or application Form is subject to approval of AstroDhyaan, once the same is accepted, your profile will be activated by AstroDhyaan.
A member or user or customer is one who has registered themselves or applied for availing services on the AstroDhyaan platform for advice or services from an Astrologer. A user may or may not be a paid member.
Website or portal or platform means all websites or apps owned by Astrosetu including AstroDhyaan.com. AstroDhyaan.com provides various astrology services including “Ask A Question“ service.
Service includes “Ask A Question“ service, phone/call/chat advice service provided through various platforms of AstroDhyaan. This Platform allows users to select an Astrologer and ask questions online.
You will provide true and accurate information regarding Astrology qualifications, expertise, skills, degrees, background and will maintain and update all such information during the term of this Agreement.
You will not perform or offer services or advice in any jurisdiction where you are not authorized or qualified or licensed or which is outside your expertise.
You will not advise any remedy, treatment, test, that requires an in-person physical examination of a User.
You will advise users that your advice cannot be a substitute for the advice of a physician and that your advice is for informational purposes only.
You will not provide any advice related to any matters like medical or legal which can be provided by only a qualified medical or legal expert.
You will not take any actions which may hamper, slow down, or manipulate the integrity of this portal or Site.
You will not transmit or communicate through the Site or portal any unlawful, bullying, defamatory, privacy violative, insulting, intimidating, derogatory, vulgar, indecent, racist, destructive or otherwise offensive or objectionable material.
You will not stalk, intimidate or harass any Astrologer or User or infringe upon or attempt to violate upon their privacy.
You will not violate any applicable local, national, or international law of any kind.
You will not attempt to contact the User for any sort of payment or fee.
You will not exchange any personal contact information with any User for any purpose, which may include making offline payment or in-personal meetings.
You will not attempt to take the act for providing offline or online advice with any user provided by this portal other than use of this portal.
You will not attempt to fraudulently increase talk or chat time with User which would result in a greater payment to you.
You will be agreed to all performance ratings and reviews given by the User after availing services from you.
You will not advise on matters or games related to gambling.
You agree that you will reply to every query with a maximum turnaround time of 6 hours.
You agree that you will adhere to the format of the model answer.
Your writing should be your own words and should be free from plagiarism.
You need to provide detailed invoices at the end of the payment cycle which must contain the number of leads served date wise.
Queries will be sent on all 7 days of a week. You should also be ready to work in weekend (Sat & Sun).
If you will not be able to work on any day, then you will have to inform us well in advance.
You understand that the service provided by you are exclusive to this Platform. Subject to terms and conditions of this agreement, you grant an exclusive right and license of your services to be used in the platform.
You will not indulge in any act which results in any intellectual property violation, spread of viruses, worms, malicious software, or any other illegal or immoral act.
AstroDhyaan Portal reserves the right in its sole discretion to review the activity & status of each account & block the account of an Astrologer.
You will receive alerts or SMS notifications including daily reminders from AstroDhyaan for provision of service.
You will abide by the payment or pricing guidelines.
You agree to follow a fair price policy. AstroDhyaan reserves the right to automatically lower the price of the astrologer if it finds that the price is higher than any other competitor platform or website.
You will not share access to this platform with anyone else. You will not share the user id or password or any other credential with any other person.
You acknowledge that AstroDhyaan merely provides a platform wherein You can meet the Users, and the use of the Sites by the Astrologer is voluntary and completely at your sole and entire risk.
The management will be at liberty to dispense with your services at any time without notice or payment of any compensation and without assigning any reasons whatsoever.
You understand that AstroDhyaan promotes the Astrologers profiles through various digital and social media platforms. AstroDhyaan shall have the right to use Astrologer profile picture, content, ratings, reviews and description for promotional and advertising purposes.
You understand that all chats and phone consultations with customers of the Website will be recorded for quality assurance purposes.
The astrologer hereby undertakes not to upload, publish, email, send, or in any way disseminate any content on or through AstroDhyaan that is illegal, detrimental, menacing, abusive, harassing, tortious, slanderous, indecent, obscene, defamatory, invasive of someone else's privacy, hateful, or that exhibits racial, ethnic, or any other form of objectionable characteristics.
Astrologer understands that this is an astrology platform and only astrology services are provided through this platform. Astrologer is responsible for all predictions or advice made. Astrologer must refrain from advising below mentioned list of predictions or advice:
AstroDhyaan is not responsible for any incorrect or inaccurate content posted on the Website or in connection with the Service.
AstroDhyaan assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of communications.
AstroDhyaan is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet.
Under no circumstances will AstroDhyaan or any of its affiliates be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Website or the Service.
The Website and the Service are provided AS-IS and AstroDhyaan Portal expressly disclaims any warranty of fitness for a particular purpose or noninfringement.
Any information may be posted on the AstroDhyaan Portal for informational purposes only and is not intended to replace or substitute for any professional financial, medical, legal, or other advice.
AstroDhyaan Portal makes no representations or warranties and expressly disclaims any and all liability concerning any treatment, action by, or effect on any person following the information offered or provided.
If any user of the website has specific concerns or a situation arises in which he requires professional or medical advice, he should consult with an appropriately trained and qualified specialist.
Revenue received will be shared between Astrologer and AstroDhyaan at an agreed rate separately intimated to the Astrologer.
You understand that AstroDhyaan may reduce or change the agreed Astrologer rate to promote the platform or to give discount offers to its customers or for any other reason, in its sole discretion.
Astrologer understands that no payment shall be made for any free minutes, discount, coupon, voucher, ticket offered to customer for promotional purpose.
You understand that AstroDhyaan shall be entitled to deduct monthly software maintenance charges i.e Rs. 999 each month from your share of overall revenue earned. However, no deduction shall be made for a particular month in which your share of revenue does not exceed Rs. 20,000.
All payments to be made to Astrologers are after deduction of TDS as per Income Tax Act. 1961. Payments are to be made within 10 days of the following month.
AstroDhyaan's billing system is not error-free and shall not be liable for any problems, miscalculations or malfunctions. Astrologers can inform of such mistakes within 48 hours of discovery.
If for any reason the Member has paid but later charged back or cancelled such payment, no Astrologer Fees will be paid to the Astrologer for that transaction.
Any Astrologer advice that is disputed, and remains unresolved, will be withheld for a reasonable amount of time till the problem is resolved.
Astrologer agrees that if the customer is not satisfied with the services provided, AstroDhyaan may at its own discretion refund all or partial amount to the customer, for which no payment is to be made to the Astrologer.
Any information found to be misleading, illegal or wrong regarding qualifications, expertise, skills, degrees, background, photograph - profile shall be deactivated immediately.
Any use of abusive language, threats, or disrespectful behavior will result in cancellation of your profile for minimum 7 days.
Disclosing your real name/full name/alias name to any customer. You shall use only the display name provided by AstroDhyaan. AstroDhyaan verified Badge shall be removed.
Sharing personal information (contact numbers, bank accounts, email, social media profiles) with customers or inducing offline meetings. Account will be temporarily deactivated.
Any advice directly related to any loss or danger of life, whether animal or human - gross violation. Account will be temporarily deactivated.
Posting negative reviews on social media, disclosing company policies, or making defamatory comments about the Company or other astrologers.
Working on competing platforms providing identical services. Profile will be deactivated without warning and all earnings will be forfeited.
Not serving promotional/free calls in cordial manner or knowingly cutting/avoiding such calls.
Not giving minimum 3 hours per day and 90 hours per month to the platform. Profile may be disabled.
14.1 Company Termination
AstroDhyaan at its sole discretion may terminate this agreement without giving any reason with immediate effect by giving you a written notice to your registered mail id.
14.2 Astrologer Termination
Astrologer may terminate this Agreement only after providing a written notice of at least 30 days. During notice period:
14.3 Payment During Notice
No payment will be made to an astrologer serving notice period till full and final settlement. Any payment due will remain on hold.
14.4 Post-Termination
You agree that even after termination, you will not contact any AstroDhyaan customers. AstroDhyaan may take legal action for any violation.
17.1 Platform Usage
AstroDhyaan has provided a live streaming platform for video communication. The platform should be used in a professional way only to resolve/communicate Astrology problems/contents.
Penalty: Rs. 51,000/- for misuse - Account permanently deactivated17.2 Video Requirements
You are expected to livestream with your video switched on and focused on your face for majority of duration.
Penalty: Rs. 1,100/- per day for violation over 10 minutes - 10 days restriction17.8 Free Guidance
Treat all users with courtesy. Should not decline service to users seeking free guidance during live sessions when not engaged in paid consultation. Must not request donations in exchange for answers.
Penalty: Rs. 1,100/-Other conditions from sections 15.3, 15.4, 15.5, 15.6 also apply to live streaming with same penalties.
Any question or difference which may arise concerning this Agreement shall be referred to a single arbitrator who shall conduct proceedings in Delhi, appointed by AstroDhyaan.
The decision of such arbitrator shall be final and binding. The courts at Delhi (India) shall have exclusive jurisdiction in all matters arising out of this Agreement.
